KF – Community Use of School Facilities

The Board of Education recognizes that the Cherry Creek School District Number Five (District, CCSD) facilities belong to the school community. Therefore, it is the policy of the Board of Education to make available the use of District facilities to the community when not in use for school activities. The Board of Education also recognizes that the primary purpose of the District facilities is to implement the regular instructional program. The Board of Education further recognizes that there are costs involved in the use of facilities and that charges should be assessed so that tax money will not be used in support of non-District program activities. Any financial commitment of the District arising out of community use of school facilities is subject to appropriation by the Board of Education. Permission for use of District facilities does not constitute a District endorsement of any organization, the beliefs of an organization, individual, or group, nor the expression of any opinion regarding the nomination, retention, election, or defeat of any candidate, nor the expression of any opinion as to the passage or defeat of any issue. The Board of Education reserves the right to refuse approval or to cancel any and all Rental Agreements issued for the use of a school building, grounds, or its facilities when it is deemed that such action is necessary for the best interest of the District. The Board of Education delegates to the Superintendent or designee the authority to set fees for the use of school facilities and for other related costs. Such fees and costs shall be subject to annual review and adjustment, as approved by the Board of Education. The applicant, by signing the Rental Agreement, agrees to indemnify, defend and hold harmless the District, Board of Education, individual Board Members, Officers, Directors, Agents and Employees, and any person whose property may be within the said building, from any and all claims, liabilities, costs, causes of actions, judgments, damages, losses and expenses brought or actions filed against the School District, Board of Education, individual Board Members, Officers, Directors, Agents and Employees, in the defense of any actions or claims arising out of or relating to applicant's use of the premises and facilities. The District reserves the right to require a Public Use Bond on a form acceptable to the District, or a deposit for protection of the building, facility and equipment, and to guarantee the rental or related expenses. In addition, the District reserves the right to require evidence of insurance in the form of a certificate of insurance, which will name the School District as an additionally named insured and provide a minimum of 30-days notice of cancellation, termination or material change of the required coverage. The District will specify the minimum insurance coverage to be obtained and maintained by the Applicant during the use of the building, facility and equipment. Such insurance will be carried with insurance companies satisfactory to the District. Board of Education policies and regulations which govern school use of facilities shall, when applicable, also govern community use of school facilities. Grounds and fields may be available for limited and approved community use. This use is subject to cancellation or adjustment due to weather, maintenance needs, or field conditions. Groups wishing reserved, exclusive use will be charged a use fee in accordance with the current fee schedule. Violations of any of the provisions of this policy or its accompanying regulation shall be grounds for immediate cancellation of a current facility use agreement and/or denial of future building or facilities use rental agreements.
