JICDA – Conduct and Discipline Code

The Board of Education seeks to maintain an environment in the schools, which is conducive to learning, protective of the safety and welfare of students and staff, and free from unnecessary disruption.
Students are expected to pursue the educational program and to behave in such a way that their presence does not detract from their own education or the education of others. Students shall treat teachers, administrators, other District employees and fellow students with dignity and respect and shall behave in such a manner that their presence does not detract from a productive educational environment. Students shall be expected to comply with District, school and classroom rules. (Policy JIC) The rules: (l) shall not infringe upon constitutionally protected rights, (2) shall be clearly and specifically described, (3) shall be published on the District website or made available to students and parents/guardians in a paper form, and (4) shall have an effective date subsequent to the dissemination of the published materials. (Policy JIC) I. Suspendable and Expellable Offenses The principal may suspend or recommend expulsion of a student in third grade and higher grade levels who engages in one or more of the following specific activities while in school buildings, on school grounds, on District property, in school vehicles, or during a school-sponsored or District-sponsored activity, and off District property when the conduct has a nexus to school or any District curricular or non-curricular event. Students under the age of eighteen who are adjudicated or convicted of an offense specified in C.R.S. § 22-33-106(1)(d) shall be subject to mandatory expulsion based on the adjudication or conviction. Students enrolled in preschool, kindergarten, first grade, or second grade may only be suspended out-of-school or expelled pursuant to C.R.S. § 22-33-106.1(2) and Policy JKD-1.
  1. Causing or attempting to cause damage to District property or stealing or attempting to steal District property of value.
  2. Causing or attempting to cause damage to private property or stealing or attempting to steal private property.
  3. Commission of any act which if committed by an adult would be robbery or assault as defined by state law while on District grounds.
  4. Violation of criminal law, which has an effect on the District or on the general safety or welfare of students or staff.
  5. Violation of District policy, regulations, or established school rules.
  6. Violation of the District's policy on Weapons in School. Expulsion shall be mandatory for using or possessing a firearm in accordance with federal law. (Policy JICI)
  7. Violation of the District's Alcohol and Other Drug Use policy. (Policy JICH)
  8. Violation of the District's Violent and Aggressive Behavior policy. (Policy JICDB)
  9. Violation of the District's Tobacco-Free Schools policy. (Policy ADC)
  10. Violation of the District's policy on Sexual Discrimination and Harassment. (Regulations AC-R-2, AC-R-4)
  11. Throwing objects, unless part of a supervised District activity, that can cause bodily injury or damage property.
  12. Directing profanity, vulgar language, or obscene gestures toward other students, District personnel or visitors to the school.
  13. Engaging in verbal abuse, i.e., name calling, ethnic or racial slurs, either verbally, in writing or electronically, or derogatory statements addressed publicly to others that precipitate disruption of a District program or incite violence.
  14. Committing extortion, coercion or blackmail, i.e., obtaining money or other objects of value from an unwilling person or forcing an individual to act through the use of force or threat of force.
  15. Lying or giving false information either verbally, in writing, or electronically to a District employee.
  16. Scholastic dishonesty, which includes but is not limited to cheating on a test, plagiarism or unauthorized collaboration with another person in preparing written work.
  17. Continued willful disobedience or open and persistent defiance of proper authority, including deliberate refusal to obey a member of District staff.
  18. Repeated interference with the District's ability to provide educational opportunities to other students.
  19. Behavior on or off school property that is detrimental to the welfare, safety, or morals of other students or District personnel, including behavior that creates a threat of physical harm to the student exhibiting the behavior or another student.
  20. Violation of the District's policy on Intimidation, Harassment and Hazing, including but not limited to engaging in "hazing" activities, i.e., forcing prolonged physical activity, forcing excessive consumption of any substance, forcing prolonged deprivation of sleep, food, or drink, or any other behavior which recklessly endangers the health or safety of an individual for purposes of initiation into any student group.   21. Violation of the District's Student Dress Code policy. (Policy JICAB)
  22. Violation of the District's policy on Student Expression Rights. (Policy JICED)
  23. Making a false accusation of criminal activity against a District employee to law enforcement or to the District.
  24. Violation of the District's policy on Nondiscrimination. (Policy AC)
  25. Violation of the District's policy on Bully Prevention and Education. (Policy JICDE)
  26. Violation of the District's policy on Secret Societies/Gang Activity. (Policy JICF)
II. Students in Preschool through Second Grade In accordance with applicable law and Board policy concerning suspensions, expulsions, and other disciplinary interventions, the principal or the principal's designee may only suspend or recommend expulsion of a student in preschool, kindergarten, first grade, or second grade who engages in one or more of the following activities while on District property, in a District vehicle, at a District activity or event, or off District property when the conduct has a nexus to school or any District curricular or non-curricular event:
  1. Violation of the Board's policy on Weapons in Schools (Policy JICI). Expulsion shall be mandatory for bringing or possessing a firearm, in accordance with federal law.
  2. Violation of the Board's policy on Alcohol and Other Drug Use (Policy JICH).
  3. Conduct that endangers the health or safety of others.

III Communication of Discipline to Staff with Direct Contact with Student

The principal or the principal's designee shall communicate discipline information concerning any student enrolled in the school to any teacher who has direct contact with the student in the classroom and to any counselor or other staff member who has direct contact with the student. Any teacher or counselor who receives information shall maintain the confidentiality of the information in compliance with the Family Educational Rights and Privacy Act ("FERPA") and does not have authority to communicate the information to any other person. IV. Safety Plan Any student who causes a disruption in the classroom, on District grounds, in District vehicles, or at District activities or events shall meet with the appropriate school official who, as necessary, will develop with other school personnel a safety plan for the student.
