The Constitution of Colorado assigns to locally elected boards of education control of instruction in the public schools of their respective districts. As charged by the constitution, the General Assembly has provided for the organization of school districts, including the composition of district boards and the election of school directors.
The Board of Education of Cherry Creek School District No. 5 is thus the duly elected body corporate, under the laws of the State of Colorado, for the governance of the District. The Board possesses all powers delegated by the State to a Board of Education and shall perform all duties required by law.
Legally, then, local school boards are political subdivisions of the state and derive their power from the state constitution and acts of the General Assembly. They also have responsibilities to the local community they serve and by whom they are elected.
There are five directors on the Board of Education of Cherry Creek School District No. 5, each of whom is elected for a four‑year term.
