AC-R-3 – Sexual Harassment (Grievance Procedure – Staff Members)

This grievance procedure for sexual harassment complaints only applies to District staff members.  Students who have been sexually harassed should follow the procedures outlined in Regulation AC R-4.
  1. Staff members who believe that they have been subject to sexual harassment should:
    1. Report the incident to their supervisor, building principal, or other building administrator who will inform the Assistant Superintendent of Human Resources of such reports. or
    2. Report the incident directly to the Assistant Superintendent of Human Resources.
The Assistant Superintendent of Human Resources will investigate or appoint a grievance officer to investigate the reported incident.
  1. The grievance officer will attempt to resolve the problem, if warranted, in an informal manner through the following process:
    1. The grievance officer will investigate and respond to the complaint in a timely manner.
    2. The grievance officer will confer with the charging party in order to obtain a clear understanding of the basis of the complaint.
    3. The grievance officer will then attempt to meet with the charged party in order to obtain a response to the complaint.
    4. The grievance officer may hold as many meetings with the parties as is necessary to gather facts and obtain statements from witnesses if available.
  2. On the basis of the grievance officer's investigation into the situation, the grievance officer may:
    1. Attempt to resolve the matter informally through conciliation.

or

    1. Report the incident and transfer the record to the Assistant Superintendent of Human Resources and so notify the parties.
  1. After reviewing the record made by the grievance officer, the Assistant Superintendent of Human Resources may attempt to gather any more evidence necessary to decide the case and thereafter impose any sanctions deemed appropriate.
